Terms of service

1. Who we are and what these terms cover
These terms apply to your use of the Pact website and the Pact browser extension (together, the "Service"), offered by [COMPANY NAME], [address], KvK [number] ("Pact", "we"). See company details. By using the Service you agree to these terms. Plans and challenges have extra rules in the plan terms, which take precedence for them.
2. The Service
Pact helps you pause impulse purchases: you set rules, Pact interrupts you when you click a purchase button on shops you chose, saves the product to a waitlist and records the decision you make later. Pact is an early product and may contain errors. Pact may not recognise every shop or button.
3. Who may use Pact
You must be 18 or older. Pact is a self-help tool for everyday impulse purchases. It is not meant for people in acute financial difficulty or who feel they have lost control over spending, and it does not replace professional help. If that applies to you, please contact a qualified professional.
4. No advice
Pact does not give financial, legal, tax, medical or psychological advice and does not make decisions for you. Information shown in Pact (such as amounts or milestones) is based on what you enter or confirm and is not a guarantee of savings.
5. Your choices and responsibility
You choose your rules, exceptions and decisions, and you remain responsible for your purchases. Pact is not a barrier you cannot pass: you can always continue, switch Pact off or remove it. We do not guarantee that Pact will prevent any purchase.
6. Third-party shops
Pact is independent of the shops you use and is not affiliated with them. Shops can change their websites at any time, which can stop Pact from working on them. We are not responsible for shops, their products or their prices.
7. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable licence to use the extension for your own non-commercial use. You must not copy, resell or reverse engineer the Service except where the law allows it, misuse it, attempt to disrupt it, or use it to violate the rights of others. We may suspend access for serious misuse.
8. Plans and payment
Details of the plans are in the plan terms. In short:
- Prices. The price, billing period and what is included are shown before you buy, including VAT. [Prices]
- Renewal. Pact Personal and Pact Pro renew automatically only if this was clearly shown before purchase. We will remind you before each annual renewal [number of days] in advance by email, and you can cancel at any time.
- Cancelling. You can cancel online in the same way you signed up, without contacting us. Cancellation takes effect at the end of the period you paid for unless we state otherwise.
- Pact for Life. A one-time payment, limited to the first 50 members, for [define precisely: for example the lifetime of the Service, or a fixed number of years].
- Withdrawal and refunds. See Cancellation and refunds.
- Price changes. We do not raise the price during a paid period. Changes apply at renewal and are announced in advance.
9. Availability and changes to the Service
We work to keep the Service available but do not promise uninterrupted operation. We may change, add or remove features. For paid plans we will not materially reduce what you paid for without a fair remedy [confirm].
10. Intellectual property
The Service, name, logo and content belong to us or our licensors. You keep the rights to the data you enter.
11. Liability
Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence and your mandatory consumer rights. Subject to that, we are not liable for indirect or consequential loss, and our total liability for a claim is limited to [for example the amount you paid us in the 12 months before the event, or a fixed amount]. 12. Ending use
You can stop using Pact at any time and delete your data (in your portal and in the extension settings). We may end the Service or your access with reasonable notice, or immediately for serious misuse.
13. Changes to these terms
We may change these terms. We will tell you about material changes in advance. If you keep using the Service after the change takes effect you accept the new terms. If you do not agree, you may stop using it and, for paid plans, cancel.
14. Governing law and complaints
Dutch law applies, without taking away mandatory consumer protection of the country where you live.
